Jose Guevara, 50, is dead following an accident in West Valley City, Utah, between his vehicle and another on October 26, 2010. According to the Salt Lake Tribune, a woman, 42 years old, was driving a van west on a frontage road that runs parallel to State Road 201, around 3800 West. It was around 5 p.m. when a woman driving the van drifted into the opposing lane of travel, the eastbound lane, and collided with the sedan driven by Jose Guevara. Sadly, Mr. Guevara died at the scene despite wearing a seat belt. His wife, 56 years old, was said to be critically injured. It is unknown if she was restrained or not. Police are currently investigating whether the woman who struck the sedan was under the influence at the time of this West Valley City accident.
I send my condolences to the family of this man and express my best wishes to Mrs. Guevara as she recovers from her serious personal injuries.
It goes without saying that a motorist who drives into the opposing lane of travel without a valid reason for doing so will be responsible for all the harm that follows. In this case, that harm is significant. I would recommend that the family of the deceased and the injured woman contact an experienced Utah wrongful death and accident lawyer to find out what remedies are available in a situation like this.
