Anthony Villasenor, 13 years old, of Eagle Mountain, Utah, lost his life after an automobile accident in southern Wyoming on Sunday, March 20, 2011. According to KSL News, the driver of the van the young boy was in, lost control as she was heading west on the I-80, just west of Rawlins. According to reports, the van veered off the road and rolled. Law enforcement say the van was going to fast for conditions. At the point that the van rolled, the boy was partially thrown from the van. He was taken to a local hospital where he passed away. Nine others in the van were said to have been injured and were also taken to the hospital where they were treated and released. The driver was cited for not having children in the van properly restrained with seat belts.
I offer my sincere condolences to the family of Anthony Villasenor for his untimely, and what sounds to be, a preventable death.
From the story, it sounds as if Anthony, like the others in the van, would still be around if he was properly restrained. I wish everyone would get the message that seat belts can save lives and should always be worn. The driver of a car also needs to make sure that their passengers are properly wearing their seat belts too. As a parent, I find that my kids sometimes try to get away without wearing their seat belts. At times, I have had to pull the car over to make sure the seat belt is clicked before proceeding further.
Legally speaking, the family of Anthony as well as others injured, have a claim against the driver’s or the van’s auto insurance policy. Under-insured coverage may also be available in this situation.
